As we learn more of the misdemeanor charges filed against Sebastian Janikowski the more it becomes clear that he’s unlikely to face any stern discipline. That’s not to say this is a non-issue. Until a clear resolution to the matter is in sight this is going to be something to keep an eye on.
However with more information coming to light it looks as if this will be yet another close call with the law for Seabass.
Robert Salonga of the Contra Costa Times reported some of the allegations surrounding Jano’s latest case. While I might not be as versed in the law as I am in Raider defensive backs I do know a hollow case when I see one. Whatever happened in that club in Walnut Creek doesn’t seem to have enough evidence to prosecute to the full extent of the law.
Aside from the fact that there are almost no witnesses that have come forward and that the accuser hardly remembered what Janikowski looked like, there is also the issue of alcohol impairment. According to Salonga’s report the woman accusing Janikowski admittedly drank alcohol “heavily” on the evening in question and was “drinking water trying to sober up” just before the alleged incident occurred.
Then there’s the fact that the accuser herself had assumed the case was closed until recently hearing that an investigation was still on-going.
There is no way to begin to speculate what really happened. Janikowski was supposedly enraged that his picture was being taken at the nightclub that he cornered the woman and backed her into a walk-in refrigerator. Even if the charges stick there is a maximum fine of $3,000 and a potential 18-month jail sentence. To me it would seem doubtful that Jano will see anything close to either of those penalties if this even gets that far.
